Governance and regulations

High standards of corporate and personal conduct are a requirement for the LPC and its members.  All aspects of the LPC’s operations must be open to critical scrutiny. To achieve these values and behaviours, rules and procedures need to be in place and that is what good governance is about: making sure the LPC is acting transparently, honestly and not in the self-interest of its members.

Following work with LPCs to implement the Review Steering Group (RSG recommendations) in relation to LPC and Community Pharmacy England governance, a shared Governance Framework and Code of Conduct applicable to Community Pharmacy England and the network of LPCs is available. Competition law

LPCs, being a representative body for pharmacy owners in their area, bring together several parties, some of whom are competitors. This can cause concerns over competition law, if commercially sensitive information is disclosed or discussed during an LPC meeting.

To avoid these concerns, participants of LPC meetings (whether it be a formal committee or sub-committee meeting or a more informal occasion) should take care in discussions with other attendees who are or may become competitors. The guidelines below provide a framework for such discussions and should be adhered to where appropriate.

The General Data Protection Regulation (GDPR)

The General Data Protection Regulation (GDPR) and the UK Data Protection Act 2018 came into force on 25th May 2018. This represents an overhaul of data protection legislation and all organisations, including community pharmacy businesses, will need to take steps to ensure that they comply with it. Community Pharmacy England, with other stakeholders, has worked to develop a range of guidance and resources to help pharmacy owners to comply with the new legislation.

Running an AGM

Every year LPCs are required, under the LPC Constitution, to hold an Annual General Meeting (AGM) where the LPC Annual Report and LPC accounts are presented to their pharmacy owners. There is also a requirement to have a pharmacy owner vote to approve the accounts.

The AGM and pharmacy owner voting on the accounts can be done virtually as required by the LPC Constitution. Below is a guide and accompanying resources on how to conduct a virtual LPC AGM and electronic voting.
